Guilderland Police Department Sex Offender Notifications
The Guilderland Police Department may
release the following information pursuant to Article 6-C of the New York
State Correction Law which authorizes law enforcement agencies to inform the
public of a sex offenders release when; in the discretion of the agency, the
release of information will enhance public safety and protection.
The individuals who appear in these notifications have been convicted of a
sex offense that requires registration with the Division of Criminal Justice
Services. Further, their classification level reflects that the potential to
re-offend is moderate or high. THEY ARE NOT WANTED BY THE POLICE, THESE
NOTIFICATIONS ARE NOT INTENDED TO INCREASE FEAR; RATHER, IT IS OUR BELIEF
THAT AN INFORMED PUBLIC IS A SAFER PUBLIC.
The Guilderland Police Department has no legal authority to direct
where a sex offender may or may not live. Unless court ordered restrictions
exist, this offender is constitutionally free to live wherever he chooses.
Sex offenders have always lived in our communities; but it was not until the
passage of Megan's Law (Sex Offender Registration Act) that law enforcement
even knew where they were living. In many cases, law enforcement is now able
to share that information with you. Citizen abuse of this information to
threaten, intimidate or harass registered sex offenders is illegal. Further,
such abuse could potentially end law enforcement's ability to do community
notifications.
